Crime in Udbina (Dane Radočaj et all.)

On 26 April 2016, the County Court Rijeka pronaunced quilty:
I. defendant Dane Radočaj - 15 years of prison
Il. def. Ćuruvija Nikola - 15 years of prison
III. def. Kosanović Đorđe - 12 years of prison
IV. def. Radislav Korač - 10 years of prison
V. def. Galović Dragan - 6 years of prison
VI. def. Radočaj Damir and VII Radočaj Dane - Jablan are aquited due to lack of evidence.
The trial started in December 2014. All dfendants were trial in absentia.

Criminal proceedings against Dane Radočaj for war crime against civilian population, Article 120, paragraph 1 OKZ RH.

INDICTMENT (Summary)

The indictment alleges Dane Radočaj- Gajota, Nikola Ćurivija, Đorđe Kosanović, Radoslav Korać, Dragan Galović, Damir Radočaj and Dane Radočaj- Jablan, as members of the so-called Milicija SAO Krajina that on 23 August 1991 detained the Muslims Ćazim Vilić, Ale Vilić and Jasmin Vilić in the dressing room of NK Krbava which at that moment served as headquarters. After they have released Jasmin Vilić they have brutally beaten up Ale Vilić, as well as Ćazim Vilić who was beaten up to death. After that they have taken Ale Vilić as well as the dead body of Ćazim Vilić to Krčan (Gospić) where the first accused Dane Radočaj and the second accused Nikola Ćurivija shot Ćazim Vilić dead. One day later their bodies were thrown into a pit so-called “ Bezdanka” where they were found on 6 September 1993 and 13 September 1991. By committing such acts the accused are alleged to have committed war crime under Article 120, paragraph 1 OKZ RH.

Pursuant to Article 5, paragraph 2 of the Regulation on the Implementation of the Law of Validation in cases of judicial nature the indictment was aligned with the Public Prosecutor’s Office in Knin from 1992.

According to the indictment issued by the Public Prosecutor in Knin, Republic of Srpska Krajina on 27 January 1992, the seven accused, Dane Radočaj- Gajota, Nikola Ćurivija, Đorđe Kosanović, Radoslav Korać, Dragan Galović, Damir Radočaj and Dane Radočaj- Jablan are alleged that on the 23 August 1991 in Udbina, inside the dressing rooms of NK Krbava, that at the time was used as headquarters, detained the brothers Ćazim Vilić and Jasmin Vilić for investigations regarding the stealing of sheep in the area of Udbine. Jasmin Vilić was released while Ali Vilić was kept for investigatitative questioning. During the questioning Ćazim Vilić was  heavely beaten  to death. According to the testimony given by Ali Vilić, the first and the second accused decided to kill him as well, and therefore the second and third accused have taken Ali Vujić together with the body of Ćazim Vilić on the meadow by a secondary road in the town Ondirć (Gospić) where the first and the second accused have shot him dead. Their bodies were thrown into the pit called “ Bezdanka”, where the bodies were later found. With these acts, all of the accused are alleged for committing the crime killing, Article 36, paragraph 2 KZRSK (victim Ćazim Vilić) and killing of Ale Vilić, Article 36, and paragraph 2, KZRSK.

TERRITORIAL JURISDICTION

Pursuant to decision VSRH II/4 Kr 100-10/3 dated 31 August 2010, on the proposal of the County Court in Gospić the territorial jurisdiction was transferred to the County Court in Karlovac.

This case was transferred to the County Court in Rijeka due to the reforms of the Law on implementation of the Statute of the International Criminal Court and prosecution of criminal offences that have breached international law of the war as well as the international humanitarian law.
